WEBSITE & SERVICES TERMS & CONDITIONS AGREEMENT

1. Introduction
Welcome!
Soulbreeze Yoga Retreats welcomes you. Please READ carefully. Your access and use of this Website (defined below) is subject to legally binding terms and conditions, which you accept and agree to by accessing this Webite.
1.1 The website www.soulbreeze.org (the “Website”) is owned and operated by “Sofia Athanasiadi – Soulbreeze Yoga Retreats” (“Company”, “Soulbreeze”, “we”, “us” and “our”), a private company legally seated in Athens, Greece. SOULBREEZE offers yoga classes and organizes yoga retreats (“Services”).
1.2 By using the Website by any means or by making a reservation for our Services, the users of the Website (“Users”) and/or any clients making bookings for our Services (“Guests”) (both “Users” and “Guests” hereinafter referred to as “You”, “Your” or “Yours”) fully and unconditionally accept these Terms & Conditions (“Terms”). The Terms apply in full force, just as if they had been made in writing and signed. If you do not agree to these Terms, please do not use the Website. By using the Website by any means, you represent that you have the authority, right, and capacity to enter into this agreement and that you will abide by all of the present Terms.
2. Applicability
2.1 To use or access our Website and Services and to make a reservation on the Website you must be eighteen (18) years of age or older than the age of majority. You agree that all information submitted is accurate and truthful.
3. Retreats | Terms & Conditions
3.1 RESERVATIONS
When you reserve a spot at Soulbreeze Retreats, your attendance is confirmed upon payment completion. To secure your booking, you have to pay a minimum non-refundable deposit of 600€ per guest within 24 hours of the booking. You are allowed to transfer your booking within the calendar year for a spot of equal or higher value, subject to availability. The balance payment shall be completed no later than 90 days before the day you are due to arrive. If your balance payment is not received on time, your place may be reassigned to another Guest. Last-minute bookings, ie. bookings made less than 90 days before the retreat, must be paid in full at the time of booking. You may choose to pay the balance of your fee in one go or in up to three monthly settlements with a 90€ upcharge, upon request. We will inform you about the exact dates in which the installments shall be due. Your attendance is confirmed upon payment completion of the final installment. If you do not execute all payments, your attendance will be canceled.
3.2 GROUP & PRIVATE RETREAT RESERVATIONS
If you wish to make a group reservation, you may add in the comments section of the reservation form the total number of attendees, their names, e-mails, preferred accommodation, dietary restrictions and promo codes (if applicable). You guarantee that you have the right to submit personal data of other persons to us. You may also make a reservation for a private retreat via email at hello@soulbreeze.org.
3.3 CANCELLATIONS BY YOU
If you cancel up to 90 days before the Check-In Day, you will receive back 100% refund, minus the deposit. For cancellations between 61 and 90 days before the date of arrival, you will receive back 50% refund, minus the deposit. Due to our need to commit to accommodation and other arrangements in advance, no refund is given for cancellations made within 60 days before your planned arrival. We do not offer credit for arriving late or leaving early.
3.4 CANCELLATIONS DUE TO COVID-19
Bookings are rebookable within the calendar year in case the participant cannot travel due to infection by COVID-19 and provided there is sufficient proof (medical statement in regard to COVID-19). Bookings are revokable and fully refundable (incl. deposit) in case the participant cannot travel due to government-imposed travel restrictions (specifically, travel ban or cancellation of commercial flights between the participant’s country of residence and Greece). Cancellations of this nature will be accepted only 10 days before the retreat begins. Cancellations requested before this timeframe are subject to regular cancellation policy.
3.5 CANCELLATIONS BY US
If for any reason whatsoever we cancel any Service, we will inform you as soon as possible. In this case, you will have the right to join another retreat (for a spot of equal or lower value, subject to availability) or request a refund of your payment. Company shall not be held liable for any expenses incurred in preparation for any canceled retreat e.g., accommodation, tickets, loss of work, or other expenses associated with the preparation for your retreat trip.
3.6 RESERVATION OF RIGHTS
We have the right to make any changes deemed necessary to our retreats without offering a refund. For example, we may replace your yoga teacher in case of illness or emergency or any other reason at our absolute discretion. We may also change the premises that the retreat will take place, due to emergency or force majeure, or any other reason at our absolute discretion, always offering you another venue of equal value.
3.7 FORCE MAJEURE
In no event shall Company be held liable to you for any failure, delay, malperformance or non-performance of its obligations arising out or caused by forces beyond its reasonable control including without limitation strikes, acts of war or terrorism, pandemic, lockdown, governmental orders, civil or military disturbances, natural catastrophes, loss or malfunctions of utilities, communications or computer services, and for any force majeure circumstances arising in your travel destination, be it political upheavals (war, governmental lockdown) or natural disasters (pandemic, catastrophic, earthquakes, wildfires or floods, volcano eruption).
4. Yoga Classes - Moon Rituals | Terms & Conditions
4.1 RESERVATIONS
If you wish to make a reservation for a yoga session or a moon ritual via the Website, by clicking “Request to join” or “Request your session” you are transferred to the Whatsapp Webpage where you can start a chat with us and make a reservation. Your attendance is confirmed upon payment completion.
4.2 CANCELLATION POLICY
Your booking is non refundable in case of cancellation or failure to show up to the event. Your booking is transferrable to another date, subject to availability, if you disclose your request to cancel your attendance up to 24 hours before the session begins. If for any reason whatsoever we cancel a session, you will have the right to make a rebooking (at the same price or lower) or request a refund of your payment. Company shall not be held liable for any expenses incurred in preparation for any canceled session (e.g., accommodation, tickets, loss of work, or other expenses associated with the preparation for your session).
5. Special Terms applying to Yoga Retreats, Yoga Classes and Moon Rituals
5.1 Our Services are designed to entertain and inform and are not a substitute for medical attention, examination, diagnosis or treatment. Our Services include physical activity, which consists of physical movements as well as relaxation and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. Under certain medical conditions, yoga is not recommended and may not be safe. It is your responsibility to inform the instructor of any health limitations before class begins. It is also your responsibility to discontinue any activity that makes you feel uncomfortable and ask for support from the instructor during the class. To attend class, you affirm that a licensed physician has verified your good health and physical condition in order to participate in such a fitness program or has approved your participation in case you are under special circumstances like pregnancy, or post-natal or post-surgical time. You are solely responsible for your health and your ability to attend such sessions and you attend sessions entirely at your own risk. You hereby agree to irrevocably release and waive any claims against Soulbreeze Yoga Retreats, its owners, officers, employees, and instructors and you assume full responsibility for any and all damages, which may incur through participation. We also strongly advise you to examine your health insurance before purchasing one of our retreats or other yoga sessions.
6. General Waiver - Limitation of liability
6.1 We shall not be responsible of any loss or damage you suffer unless it is a result of our breach of these Terms or our negligence. We shall be held liable only up to the value of the fee paid by you. We shall not be held responsible for any loss or damage that is not foreseeable nor that is consequential or for incidents that may occur during the provision of the Services (e.g., illnesses, personal injuries, traumas or death) unless caused by our negligence.
6.2 Given the nature and volume of the information on the Internet, under no circumstances, including that of negligence, shall Company or its representatives be held liable for any form of loss or damage sustained by the Users of the Website, use of which they make entirely and solely at their own initiative and responsibility. Under no circumstances, including, but not limited to, negligence will Company or its representatives be held liable for any form of loss or damage resulting from your use or your inability to use the Website.
7. Payment methods
7.1 You may execute payments via PayPal or via a bank transfer to the bank details indicated within the confirmation email we send you.
8. Intellectual Property Rights
8.1 All content included in or made available through the Website, including but not limited to texts, graphics, logos, images, audio clips, videos, designs, source code, and the Website as a whole, is the intellectual property of Company and protected by the applicable copyright laws. Company owns all intellectual property rights either directly as the creator or indirectly licensed by the respective creators. It is prohibited, among other things, to copy the design, graphics, images, texts, logos and the entire content of the Website, to reproduce, modify, publish or distribute by any means any content of the Website, in whole or in part. It is also prohibited to decompile or by any means make unauthorized use of the Website’s software.
8.2 The features appearing on the Website are either registered trademarks of the Company or third parties and enjoy protection under the applicable trademark laws and international conventions and treaties. The display of these trademarks on the Website shall under no circumstances be regarded as a license to use these trademarks without prior written permission of Company.
8.3 Any infringements of intellectual property rights set out in paragraphs 2.1 and 2.2 by any means shall draw the subsequent penalties and liability foreseen by applicable law.
9. Privacy Policy & Processing of personal data
9.1 The processing of your personal data is carried out in accordance with the Privacy Notice of the Website.
10. Links to third party websites
10.1 The Website may contain links, hyperlinks, banners or tabs leading to websites operated by third-parties. The content and use of such websites shall be subject to the terms of use of the respective websites. Under no circumstances shall Company guarantee that these links will operate without interruption. Company reserves the right to remove or add links without notice and to change the content of the Website at any time. You acknowledge that under no circumstances shall we or our representatives be held liable for the content of the hyperlinks the Website contains, the policy of those sites regarding personal data processing, the services/products the external sites may offer, the advertisements they may contain nor for any financial or other form of loss or damage suffered by a viewer visiting such sites.
11. No warranty
11.1 All services and any kind of content of the Website is offered ‘as is’, with no guarantee, explicit or implied, of any kind in relation to its commercial use or its suitability for any specific purpose. No explicit guarantee is given that the pages, services, features, options and contents of the Website will be provided without interruption or errors, or that any errors will be corrected. Despite our efforts, there is no guarantee that the Website does not contain viruses or other harmful content.
12. Indemnification
12.1 You are liable towards Company and its Partners, for any damage caused as a result of illegal or harmful use of the Website from your side or any use in a manner that does not comply with the present Terms. You agree to indemnify, defend and hold us harmless immediately on demand, from and against all liability, damages, losses, costs and expenses, including legal fees, arising out of any liabilities arising out of your use of the Website or any breach of these Terms.
13. Amendment of Terms
13.1 Company reserves the right to modify at any time the contents and scope of these Terms even without notice. For this reason, we encourage you to visit this page from time to time to get informed of any changes. In the event of any subsequent amendment of the Terms, if you use the Website at a future date, this shall imply that you accept the new Terms.
14. Applicable law and other terms
14.1 The above Terms, and any amendment thereof, are governed and supplemented by Greek law, the law of the European Union and the relevant international conventions to which Greece is a signatory. It is agreed that all the above Terms are of equal substance. If any provision of the above is contrary to the law, shall automatically cease to apply and shall be removed, without affecting in any way the validity of the other terms.
14.2 Soulbreeze Yoga Retreats and Guests shall make every effort, so that any difference, dispute or disagreement that may arise during the conclusion, interpretation and execution of the present Terms & Conditions, as well as claims related to them, is resolved out of court, with negotiations in a spirit of good faith within reasonable time after the date of the written expression of the disagreement by any of the parties. If a difference is not resolved in this way, competent for its judicial resolution shall be the Courts of Athens, Greece exclusively, which shall decide on any trials regarding the execution and the Greek law shall apply.
